Frequently asked questions
Is there a personal data protection law in Venezuela?
As of this review, Venezuela has no general personal data protection law. Protection rests on article 28 of the Constitution (habeas data), Constitutional Chamber case law and sector rules. If a platform serves users in the European Union or Brazil, the GDPR or the LGPD may also apply.
Is an electronically signed contract valid in Venezuela?
Yes. The Law on Data Messages and Electronic Signatures gives data messages the same evidentiary value as written documents. An electronic signature certified by a provider accredited with SUSCERTE gives greater certainty about authorship, although it is not the only way to prove an electronic agreement.
How can a foreign company hire a developer living in Venezuela?
Through a services agreement with an independent professional or through an employment relationship. The difference depends on the reality of the relationship, not the contract's name: if there is subordination, set hours and dependence, it may be considered employment under the LOTTT. Code ownership and confidentiality should be clearly defined.
