Frequently asked questions
What is the deadline to file an amparo action in Venezuela?
The Organic Law on Amparo makes the action inadmissible when six months have passed since the violation or threat without the injured party acting, except for violations of public order or morality. Amparo is also unavailable if another adequate ordinary remedy exists, so each case must be assessed before choosing it.
What is habeas data?
It is the action that allows anyone to know what data about them is held in public or private records, what it is used for, and to request its update, correction or destruction if it is wrong or unlawfully affects their rights (article 28 of the Constitution).
What is constitutional review of a judgment?
It is an extraordinary, discretionary power of the Constitutional Chamber to review final judgments of other courts that contradict its binding interpretation of the Constitution or contain serious errors of constitutional interpretation. It is not a third instance.
